IN THE HIGH COURT OF JUDICATURE AT PATNA
Civil Writ Jurisdiction Case No.11990 of 2008 ====================================================== Sudhir Kumar, son of Sri Bhagwat Prasad, resident of village and P.O. Juniar, P.S. Hilsa, District Nalanda .... .... Petitioner
Versus
1. The State of Bihar
2. The Secretary to the Government of Bihar, Road Construction Department, Bihar, Patna
3. The Engineer-in-Chief, Road Construction Department, Bihar, Patna
4. The Chief Engineer, Advocate Planning Division Road Construction Department, Bihar, Patna
5. The Secretary, Govt. of Bihar, Personnel and Administrative Reforms Department, Bihar, Patna .... .... Respondents ====================================================== Appearance :
For the Petitioner/s : None For the Respondent/s : Mr. (Aag11) ====================================================== CORAM: HONOURABLE MR. JUSTICE MIHIR KUMAR JHA ORAL ORDER 27-07-2015 No one appears for the petitioner.
The prayer of the petitioner in this writ application reads as follows:
"Commanding the respondents to appoint petitioner on compassionate ground on any post, on account of the deemed death of his father Sri Bhagwat Prasad who was working as the head Typist in the office of the Advance Planning Division Road Construction Department, Bihar, Patna and quashing the order of the Engineer-in-Chief, contained in memo no. 1343(E) dated 20.3.2002 refusing the prayer of the petitioners for appointment on compassionate ground."
Having regard to the fact that the father of the petitioner is said to have become traceless way back in the year 1994 and that a
Patna High Court CWJC No.11990 of 2008 (2) dt.27-07-2015 period of more than 21 years has been completed in which the family has survived, this Court would now find no reason to quash the order relating to refusal of appointment of the petitioner on compassionate ground.
This application is, accordingly, dismissed.
