Petitioners, who are in custody, seek bail in connection with Muffasil P.S. Case No. 422 of 2015 registered for the offence punishable under Sections 120(B) of the Indian Penal Code and Section 25(1-B)A, 26 of Arms Act. Petitioners had earlier moved this Court for anticipatory bail vide Cr. Misc. No. 8379 of 2016 which was rejected on 18.04.2016 and thereafter petitioner No. 1 moved this Court for anticipatory bail vide Cr. Misc. No. 20076 of 2016 which was rejected on 05.10.2016 and thereafter petitioner No. 2 again moved this Court for anticipatory bail vide Cr. Misc.

Patna High Court CR. MISC. No.51639 of 2019(3) dt.01-10-2019 2/3 No. 48941 of 2016 which was also rejected on 18.01.2017. Informant who in his written complaint has stated that on 16.11.2015 his co-villager Rahul Kumar informed him on telephone that Ravi Shekhar Singh and Munna Singh (petitioners) handed over him a country made pistol and two cartridges to murder him and after murder he would be paid Rs. 2 lacs. Thereafter he informed the police and went at the house of Rahul Kumar where Rahul Kumar narrated whole story and handed over a pistol and two cartridges to them. It has been submitted on behalf of petitioners that he is innocent and has been falsely implicated in this case. It has been further submitted that informant and Rahul Kumar are closed to each other and both are involved in several crime. Petitioner is in custody since 01.06.2019.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya, District- Gaya, in connection with Muffasil P.S. Case No. 422 of 2015 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and

Patna High Court CR. MISC. No.51639 of 2019(3) dt.01-10-2019 3/3 shall be properly represented on each and every date fixed by the court and their absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel their bail bonds.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
