JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Hajipur Town P.S. Case No. 906 of 2016 registered under Sections 420, 406, 467, 471, 472 and 120B of the Indian Penal Code.

As per the prosecution case, on the information of the petitioner that the land of one Dinanath Singh is for sale, the informant contacted with Dinanath Singh and purchased the land from him and got the sale deed executed and his name mutated, but later on he came to know that the said vendor is an imposter and the land does not belong to him.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has been falsely

The petitioner has played no role in sale of the land rather he had only informed the informant about the land of Dinanath Singh and the informant himself after proper verification of the land in question, got the sale deed executed and his name mutated. The petitioner has been languishing in custody since 13.04.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 906 of 2016.
