Case No. 29 of 2019, registered for the offences punishable under Section 376 of the Indian Penal Code and Section 4 of POCSO Act.
Allegation against the petitioner is of committing rape upon 10 years old daughter of the informant.
Submission of learned counsel for the petitioner is that he is aged 68 years and due to dispute he has falsely been implicated and medical report does not support the prosecution case.
Heard learned APP, who has opposed the prayer for bail stating that he was apprehended while committing rape and apart from that the victim girl has also supported the prosecution case in her statement under Section 164 Cr.P.C. who is aged 10
Patna High Court CR. MISC. No.50899 of 2019(6) dt.20-02-2020 2/2 years.
In view of above facts and circumstances, I am not inclined to grant bail to the petitioner. However, since the charge has been framed in this case, learned trial court is directed to expedite the trial and try to conclude the same as soon as possible.
Accordingly, this application is dismissed.
