The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 384, 386, 504, 506 and 120B of the Indian Penal Code. The prosecution case is that the informant received an extortion call through mobile and subsequently life threatening. Subsequently the police traced some miscreants through unknown mobile number and after apprehending brought them to the police station when the informant identified them as persons against whom the informant imposed fine for stealing he buffalo in order to spread communal frenzy. Patna High Court Cr.Misc. No.6239 of 2016 (2) dt.09-02-2016 2/2 petitioner that the alleged mobile through which extortion was demanded was seized from the house of co-accused Md. Sabir. It is further submitted that earlier the brother of the petitioner filed Birpur (Balua Bazar) P.S. Case No. 138 of 2000 against the brother of the informant and others and Md. Sabir in his confession has not named the petitioner.

Considering the nature of accusation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Birpur (Balua Bazar) P.S. Case No. 176 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Birpur, Supaul. With the aforesaid observation, this application is disposed of.
