JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Sessions Trial No. 274 of 2011 arising out of Kanhauli P.S. Case No. 26 of 2009 registered under Sections 304B, 201 and 34 of the Indian Penal Code.

The petitioner happens to be the brother-in-law of the deceased who has been indicted with committing dowry death of the deceased along with other accused persons. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He happens to be brother-in-law of the deceased. The allegation levelled against him is not specific rather general and omnibus in

Patna High Court Cr.Misc. No.30975 of 2017 (2) dt.06-07-2017 2/2 nature. The husband of the deceased has been acquitted by the trial court and the Mother-in-law of the deceased has been enlarged on bail by a co-ordinate bench of this court vide order dated 16.05.2017 passed in Cr. Misc. No. 17308 of 2017. It is further submitted by learned counsel for the petitioner that though the petitioner has been declared absconder, but later on he was arrested by the police and he is facing trial. Charge in the case has been framed. The petitioner has been languishing in custody since 17.01.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Fast Track No.3, Sitamarhi in connection with Sessions Trial No. 274 of 2011 arising out of Kanhauli P.S. Case No. 26 of 2009.
