JUSTICE BIBEK CHAUDHURI ORAL ORDER 03-09-2024 The petitioner has approached this Court in extraordinary jurisdiction under Article 226 of the Constitution of India, alleging, inter alia, that by an order dated 19th of July, 2023, in a departmental proceeding he was punished with the penalty of reduction to lower time scale of pay. Against the said order, the petitioner preferred an appeal on 1st of September, 2023. The said appeal has not been disposed of during this period of one year. Therefore, the petitioner has prayed for direction upon the Additional Chief Secretary, Road Constitution Department, for disposal of the appeal at an early date.

2. Without going through the merit of the case, the Respondent No. 1 is directed to dispose of the appeal of the

Patna High Court CWJC No.12862 of 2024(2) dt.03-09-2024 2/2 petitioner dated 1st of September, 2023, in accordance with law within 60 days from the date of this order.

3. It is made clear that I have not decided the merit of this case. Therefore, it is left open for the Respondent No. 1 to consider the merit of the case at the time of disposal of the appeal.

4. With the above order, the instant writ petition is disposed of.
