Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in connection with Supaul P.S. Case No.469 of 2020 dated 04.07.2020 registered for the offence/s punishable under Section/s 419, 420/34 of the Indian Penal Code.

The main submissions advanced by the learned counsel for the petitioner are that the petitioner has fair and clean antecedent and as per allegation this petitioner and several co-accused persons whose details are mentioned in the FIR replaced themselves with another persons in the physical examination concerned to the selection process of Bihar Home Guard recruitment but the said physical examination was conducted in Supaul Stadium from 25.09.2019 to 16.10.2019 and the FIR was lodged on 04.07.2020 several months later, after the commission of the alleged occurrence and the said delay has not

No.56986 of 2023(2) dt.13-09-2023 2/2 been explained and the FIR was lodged in mechanical manner against several accused persons including the petitioner out of them some co-accused persons have been granted anticipatory bail by co-ordinate Benches of this Court vide orders passed in Cr. Misc. Nos.49643 of 2021, 15746 of 2022 and 7563 of 2023 and the petitioner's case stands on similar footing with them. 4.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly petitioner's fair and clean antecedent as well as his case being similar to above-mentioned co-accused persons who have been granted anticipatory bail, in my opinion petitioner deserves to the privilege of anticipatory bail. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail in connection with Supaul P.S. Case No.469 of 2020 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
