2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126 (2 ), 127 ( 2 ), 115 ( 2 ), 109 (1) , 352, 351 ( 2 and 3(5) of BNS. 3 . The prosecution case in brief, is that informant namely Ramdayal Ray alleged that on 26.01.2025 when his nephew was at his shop, all the F.I.R. named accused persons including this petitioner came there and started quarreling with informant and when nephew of informant intervened then all the accused persons assaulted on his head with iron rod.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged. Specific accusation of assault is against co-accused Bablu

Patna High Court CR. MISC. No.53884 of 2025(2) dt.18-08-2025 2/2 Paswan who allegedly assaulted nephew of informant by means of iron rod and so far as, this petitioner is concerned, he along with other co-accused persons are only alleged to have dragged the nephew of informant. Doctor has found the injury simple in nature . Petitioner claims clean antecedent.

5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Ist Dalsingh Sarai Samastipur in connection with Dalsinghsarai P.S. Case No. 28 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 .
