Mr. A.M.P. Mehta, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-08-2019 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the complainant and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 455 (C) of 2019, registered under Section 406/34 of the Indian Penal Code.

The accusation is that the complainant settled the marriage of his daughter with the petitioner on 20.03.2018. Thereafter, ring ceremony was performed on 19.11.2018. At the time of ring ceremony, articles worth of Rs. Two lakhs as a gift were given and date of marriage was fixed on 28.02.2019. In the meantime, petitioner obtained job of P.O in Bank of Baroda. Thereafter, parents of petitioner made demand of Rs. Five lakhs as dowry. When informant requested them not to do so then they abused and assaulted the complainant.

No.50918 of 2019(2) dt.16-08-2019 2/2 Learned counsel for the petitioner submits that, in fact, the marriage of petitioner had settled with the daughter of the complainant, but due to some undisclosed reason, the marriage could not be performed and thereafter, the brother-inlaws of the complainant came at the house of petitioner and took all the gifted articles and abused the petitioner regarding which mother of petitioner gave information to S.H.O, Ram Krishna Nagar Police Station on 26.01.2019, thereafter, the complainant lodged the Complaint Case No. 455 of 2019 in the Court of Chief Judicial Magistrate, Patna.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Complaint Case No. 455 (C) of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
