In the present case, the petitioner is seeking bail in connection with Gaighat P.S. Case No. 299 of 2015 for offence under Section 364/34 of the Indian Penal Code. An allegation has been made that the petitioner and one other person has intercepted the victim and taken him to Village Bhusra and kept confined in a thatched house. They forcibly took way his mobile but he could be saved by the intervention of the police and filed First Information Report implicating the petitioner.

Learned counsel for the petitioner has produced the affidavit of three persons, namely, Ramanand Singh, Abhay

Patna High Court Cr.Misc. No.6292 of 2016 (2) dt.23-02-2016 Kumar and Prakash Kumar where he has tried to say that the petitioner has been falsely implicated in the present case on account of business rivalry.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner, namely, Sumit Chauhan is rejected.

The trial court is directed to complete the trial within a period of nine months from the date of receipt/production of a copy of this order.
