The petitioner seeks regular bail in connection with Kharagpur PS case no. 8 of 2016 registered for the offences punishable under Sections 387 of Indian Penal Code and Sections 16, 17, 18, 20, 23 of U.A.P. Act.

The allegation of the prosecution is that on 11.01.2016 at about 2.35 pm in the afternoon, while the informant was in his school, he received a phone call on his mobile and the said person threatened him with dire consequences if he did not pay a sum of Rs. 1,50,000/-. The said person who had demanded the money is said to a man of maoist party.

Learned counsel for the petitioner submits that the FIR is against unknown persons/ against caller of the mobile

Patna High Court Cr.Misc. No.29041 of 2017 (2) dt.01-07-2017 2/2 no. 8226837394, the petitioner has got no criminal antecedent and he is in custody since 10.04.2017. Learned counsel for petitioner further submits that similarly accused persons have already been granted bail by this Hon'ble Court vide order dated 17.03.2016 and 07.04.2016 passed in Cr.Misc. no. 11897 of 2016 and 14266 of 2016 respectively.

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to direct the petitioner to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur PS case no. 8 of 2016.
