The petitioner is apprehending his arrest in connection with Beur P.S. Case No. 319/2016, registered for offences punishable under Sections 414 of Indian Penal Code and 30(a) of the Bihar Prohibition Excise Act, 2016.
Allegation is of recovery of five bottles each containing 750 M.L. of Indian made foreign liquor has been recovered from the Sumo Vehicle.
It has been submitted on behalf of the petitioner that petitioner has nothing to do with the alleged recovery and he has been made accused only because he is the owner of the vehicle from which alleged recovery was made. It has further been

No.30796 of 2018 (2) dt.04-06-2018 2/2 submitted that the said vehicle is being used for the commercial purposes and the driver used to look after the affairs of the said vehicle. Further petitioner has no criminal antecedent. Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge - VIII - cum- Additional Chief Judicial Magistrate, Patna in connection with Beur P.S. Case No. 319/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
