JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 455(C) of 2019 registered for the offence punishable under Sections 406/34 of the Indian Penal Code.

As per complaint petition, marriage of son of the petitioner was fixed with daughter of the complainant but petitioner and other accused persons started demanding of Rs.5 lac and in spite of that ring ceremony was performed between the parties but petitioner and his son refused to solemnize the marriage with respect to above demand.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.52180 of 2019(3) dt.06-11-2019 2/2 that whole allegation is false and concocted and son of petitioner has already been released on anticipatory bail by a coordinate Bench of this Court by order dated 16.8.2019 in Cr.Misc.No. 50918 of 2019.

Heard learned APP and learned counsel for opposite party No.2.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Complaint Case No. 455(C) of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioner has to co-operate in disposal of complaint case and appear in court as and when required.
