The petitioner was granted provisional anticipatory bail for a period of three weeks vide order dated 28.04.2016 on the ground of marriage of his daughter scheduled to be solemnized on 29th of April, 2016 in connection with Munger Muffasil P.S. Case No. 122 of 1998. The petitioner was directed to surrender within a period of three weeks and file surrender certificate before this Court. The petitioner did not surrender. Consequently this Court vide order dated 29.06.2016 directed the Superintendent of Police, Munger to make effort to get the petitioner arrested.

A supplementary affidavit has been filed through Mr. Anuj Kumar, learned advocate having AOR No. 01550 dated 16.08.2016 is on record. The paragraph No. 3 of the supplementary affidavit stipulates that petitioner has been

Patna High Court Cr.Misc. No.11195 of 2016 (7) dt.24-08-2016 2/2 arrested and is in custody since 29.07.2016. The order of the learned Trial Court dated 29.07.2016 to that effect has also been brought on record as Annexure-A to the supplementary affidavit.

In the circumstance, the application is disposed of in connection with Sessions Trial No. 986 of 1999 arising out of Munger Mufassil P.S. Case No. 122 of 1998, pending in the Court of learned Vth Additional Sessions Judge, Munger.

Learned Trial Court is directed to expedite the trial.

In view of the fact that petitioner misused the privilege of provisional bail, learned trial Court will not entertain any bail application of the petitioner. (Dinesh Kumar Singh, J) Shageer/- U T
