JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379 and 411/34 of the Indian Penal Code.

The prosecution case is that the informant parked his bicycle at the gate of I.C.U., of Mayaganj Hospital and on return he saw one person taking his bicycle when the informant caught him who disclosed his name as Nakul Mandal who also suggested the name of three other persons including the petitioner as his accomplice.

It is submitted by learned counsel for the petitioner that admittedly, no recovery has been made from the petitioner and informant only saw Nakul Mandal taking his bicycle. A statement

Patna High Court Cr.Misc. No.6808 of 2016 (2) dt.15-02-2016 2/2 has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 836 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
