The petitioner seeks bail in Barauni Rail P.S. Case No. 36 of 2017 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Around 2.5 litres of foreign liquor is said to have been recovered from the possession of the petitioner and the petitioner was apprehended.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in this case. Nothing incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner is languishing
Patna High Court Cr.Misc. No.27875 of 2017 (2) dt.21-06-2017 2/2 in custody since 19.03.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway Barauni in connection with Barauni Rail P.S. Case No. 36 of 2017.
