The petitioner apprehends his arrest in Sarai P.S. Case No. 172/2017, registered for the offences punishable under Sections 366(A), 386, 323 and 120(B) of the Indian Penal Code. The informant filed complaint case on the basis of which the present F.I.R. was lodged. In sum and substance, the informant made allegation that the petitioner kidnapped his minor daughter with the help of other accused persons.

Learned counsel for the petitioner submits that the victim made her statement under Section 164 Cr.P.C. and disclosed that she voluntarily left her house and went along with the petitioner and solemnized marriage with him. She wanted to live with her husband. The victim is a major girl.
