The petitioner seeks bail in a case registered under Sections 302, 120(B) & 201 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in brief is that one evening, the accused persons took away the informant's son, Sonu Kumar and thereafter, next day, the dead body of the informant was found.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-05-2019. Charge sheet has already been submitted. It is a case of last seen. There is no eye witness to the alleged occurrence nor there

Patna High Court CR. MISC. No.50806 of 2019(4) dt.16-11-2019 2/2 is any circumstantial evidence to suggest that the petitioner is alleged to have participated in the said occurrence. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh in connection with Pandarakh P.S. Case No. 53 of 2019.
