JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 409, 467, 408, 471, 379, 120B of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected by this court giving liberty to him to renew his prayer for bail after four months, if his trial is not concluded within the above stated period.
However, learned counsel for the petitioner submits that charge sheet was submitted against the petitioner and others whereas investigation against some accused was kept pending and
Patna High Court Cr.Misc. No.18666 of 2017 (2) dt.21-06-2017 2/2 after that only cognizance was taken against the petitioner on 01.03.2017 and still the case of the petitioner is pending for trial. Considering the aforesaid facts and circumstances as well as this aspect of the matter that it is only stated that some stolen cash were recovered from possession of the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S.
