This application is for grant of regular bail in connection with Shambhuganj P.S.Case No.81 of 2013 , registered for the offences punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.
Allegation against the petitioner is under Section 304B of the Indian Penal Code of dowry death. Submission of the learned counsel for the petitioner is that F.I.R. itself shows that the informant has suspicion that her daughter was killed but as a matter of fact no such occurrence has taken place and she was under treatment at Delhi and from there she is traceless and the petitioner tried to inform the police about the same but no any report was recorded by the police. The
Patna High Court Cr.Misc. No.34957 of 2017 (3) dt.07-09-2017 2/2 petitioner is in custody since 14.2.2017.
Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that had the girl been traceless, the petitioner would have to approach the police but nothing is available in the case diary to shows that any step was taken to approach the police.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
With the aforesaid observation, this application is dismissed.
