JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for offences punishable under Sections 399/402 of the Indian Penal Code, Section 25 (1-b)a/26/35 of the Arms Act and Sections 47 (a) and 53 (a) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, eight plastic bottles (400 ml. each) country made liquor were recovered from the house of co-accused Umesh Paswan. Nothing has been recovered from the possession of the petitioner. The name of the petitioner has come in the confessional statement of accused persons, who were arrested on spot. It is urged that the co-accused Shambhu Mehta, Siya Ram Mehta and Jitendra @ Jito Singh @

Patna High Court Cr.Misc. No.32305 of 2017 (2) dt.13-07-2017 2/2 Jitendra Singh @ Jito have already been granted bail by different co-ordinate Benches of this Court vide Cr. Misc. No.14952 of 2017 and Cr. Misc. No.48770 of 2016 respectively. Petitioner claims his antecedent to be clean and he is in custody since 18.04.2017.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Udakishunganj, District, Madhepura in connection with Alamnagar P.S. Case No. 86 of 2016 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
