The petitioner, apprehending his arrest in connection with Fatehpur P.S. Case No. 130 of 2014 registered for the offences punishable under Sections 376 and 511/34 of the Indian Penal Code, seeks the privilege of pre-arrest bail. Allegedly, the petitioner tried to outrage the modesty of the informant. At that time his associates were also present. Submission is that it is out and out a false case and the petitioner has been implicated only with a view to lower down his prestige, to which the learned A.P.P. opposes the prayer of prearrest bail. In the facts and circumstances stated above, noticing the

Patna High Court Cr.Misc. No.29914 of 2014 (2) dt.16-01-2015 allegation attributed against the petitioner, this Court is not inclined to grant the privilege of pre-arrest bail to him but in case and if so advised, the petitioner surrenders and seeks regular bail then in that case his prayer for regular bail shall be considered on its own merit on the same date without being prejudiced by this order.
