JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 The matter has been placed before this Court in view of administrative order of Hon'ble the Acting Chief Justice dated 24.02.2016, since the Co-ordinate Bench has passed his earlier order is not available due to medical exigency. Heard learned counsel for the petitioner and the State.

Petitioner being the father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Accusation is of killing the daughter of the informant within two years of marriage for non-fulfillment of dowry demand.

Considering the specific accusation against the

Patna High Court Cr.Misc. No.7822 of 2016 (2) dt.25-02-2016 petitioner and Deepak Kumar, earlier bail application was rejected by a Coordinate Bench of this Court vide order dated 09.10.2015 passed in Cr. Misc. No. 24597 of o2015. Now the petitioner has renewed his prayer for bail on the ground that informant has retracted from the initial version and filed a petition to that effect before learned court below, that may be a ground for consideration for prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kesariya P.S. Case No. 228 of 2014, pending in the court of learned Chief Judicial Magistrate, East Champaran at Motihari.

With the above observation this application is disposed of.
