No one appears for the State.
The petitioner, in the present case, is seeking regular bail in connection with Kotwali (Tilkamanjhi) P.S. Case No. 122 of 2017 registered under Sections 25(1-b)a and 26 of the Arms Act.
Learned counsel for the petitioner submits that according to the First Information Report, in course of vehicle checking, the petitioner was apprehended and from his possession one country made pistol and a pulsor motorcycle were recovered. However, learned counsel submits that seizure shown by the
Patna High Court Cr.Misc. No.28351 of 2017 (2) dt.06-07-2017 2/2 police is not in accordance with law as contained in the Code of Criminal Procedure. The petitioner was earlier involved in two cases as stated in paragraph-3 of the application however, he has been acquitted in those cases which are of the year 2007 only. Considering the fact that petitioner is in custody since 08.03.2017 and investigation in the present case is over and also the petitioner is ready to co-operate in course of trial, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 122 of 2017 subject to condition that petitioner will appear before the trial court on each and every date and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
