Petitioner seeks bail in a case registered under Sections 30 (a)/56(d) of Bihar Prohibition and Excise Act, 2016. It is submitted that in the first information report, it has been alleged that the petitioner was riding on the recovered motorcycle bearing Registration No BR-03H-5769 and from his possession, 8 bottles of Indian made foreign liquor, containing 180 ml each, were recovered. It is further submitted by the petitioner that he is in custody since 26.03.2017 and he has no criminal antecedent. Further submission made on behalf of the petitioner is that the persons named in the FIR, against whom the allegation is of indulging in illicit trade of liquor, have already been granted
Patna High Court Cr.Misc. No.28801 of 2017 (2) dt.01-07-2017 2/2 bail by order dated 24.05.2017 passed in Cr Misc No 24303 of 2017, order dated 19.05.2017 passed in Cr Misc No 24181 of 2017 and order dated 22.05.2017 passed in Cr Misc No 22907 of 2017. Considering the aforesaid submission, the petitioner is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IV, Ara in Dhangai Police Station Case No 14 of 2017 corresponding to Excise Case No 138 of 2017.
