The petitioner is apprehending his arrest in connection with Jankinagar P.S. Case No. 174 of 2017, registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation is omnibus in nature and no specific allegation has been attributed to the petitioner. In fact, the deceased got burnt injuries while cooking and succumbed before the injuries during course of treatment. The petitioner has no concern with the alleged occurrence. The husband of the deceased lady has already been in jail custody. Moreover, some of co-accused, having more or less
Patna High Court Cr.Misc. No.31528 of 2018 (2) dt.06-06-2018 2/2 similar allegations have already been granted anticipatory bail by different co-ordinate Benches of this Court in Cr. Misc. No. 16221 of 2018 and Cr. Misc. No. 27618 of 2018. Hence, the petitioner deserves the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with Jankinagar P.S. Case No. 174 of 2017, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
