JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-05-2022 At the outset, learned counsel for the petitioner seeks permission to withdraw anticipatory bail application with respect to petitioner no.1, Shubham Kumar @ Kunal. The prayer is allowed and the application is dismissed as withdrawn with respect to petitioner no.1. Heard learned counsel for the petitioner and the State. The petitioner no. 2 prays for grant of anticipatory bail in a case registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code and sections 3, 4. 5 of Explosive Substance Act.

Petitioner is not named in the FIR and during course of investigation, his name transpired and FIR named accused

Patna High Court CR. MISC. No.65394 of 2021(2) dt.23-05-2022 2/2 persons have been granted bail by the court below. Learned counsel for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case, in the event of arrest/ surrender within four weeks from today, let the petitioner no.2 Laukesh Kumar @ Lokesh Kumar be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate VIII, Muzaffarpur in University P. S. Case no. 31 of 2017 subject to condition as laid down under section 438(2) Cr.P.C. (Prabhat Kumar Singh, J) s.hassan/- U T
