The challenge in the present writ petition is to the order dated 15.04.2013 passed in Case No. 115 of 2012 by the D.C.L.R, Pakri Dayal in the District of East Champaran. At the very outset learned counsel for the respondent no. 8 raised a preliminary objection and submitted that the order impugned is appealable under Section 14 of the Bihar Land Disputes Resolution Act, 2009 before the Divisional Commissioner.

Patna High Court CWJC No.11949 of 2014 dt.12-01-2017 2/2 Faced with the situation learned counsel for the petitioner seeks permission to withdraw the writ petition in order to move before the Appellate Authority in accordance with law. In view of the aforesaid, the writ petition stands disposed off as withdrawn with liberty aforesaid. If the petitioner approaches Appellate Authority within three weeks from today along with copy of this order the appellate authority shall decide the same on merits expeditiously.
