From perusal of the writ petition and the counter affidavit it appears that the petitioner instead of filing the writ petition for redressal of his grievance has filed the present writ petition for action against the private respondent Shailendra Kumar Sarovar.

Patna High Court CWJC No.8109 of 2015(2) dt.05-12-2018 2/2 In the counter affidavit Annexure-A bearing Memo No. 258 dated 08.02.2018 has been enclosed wherein the District Programme Officer (Establishment), Katihar has issued letter to the Panchayat Secretary, Gram Panchayat Raj Govindpur, Prakhand Falka, District Katihar in connection with joining and payment of Shailendra Kumar Sarovar, respondent no. 8.

In the peculiar facts and circumstances of the case, the Court is not inclined to grant any relief to the petitioner. If the District Programme Officer (Estt.) Katihar finds any irregularity in the activities of the Panchayat Secretary and in the matter of joining of Shailendra Kumar Sarovar, he shall take appropriate action and for which no direction is required in the instant writ petition.

The writ petition is dismissed.
