The writ application is disposed of with a direction upon the District and Sessions Judge, East Champaran at Motihari that he will verify the number of Earned Leave, which is available to the petitioner for which he is required to be paid. Payment of 145 days has already accrued to him but according to his stand, the total number of Earned Leave is 292 days. In this regard, he has also annexed Annexure- 2 to the writ application.
Looking at the nature of the dispute since there is no adjudication required but only verification required, the petitioner will appear before the District Judge with a copy of
Patna High Court CWJC No.12862 of 2015(5) dt.19-08-2017 2/2 this order. On due verification, if the stand of the petitioner is made out then the necessary authorization for the left over days of Earned Leave will be made or he will be told where he stands with regard to leave position. All this exercise must be done within a period of four weeks from the date of production of a copy of this order.
Writ stands disposed of in terms of above.
