This application for regular bail arises out of Hajipur Sadar P.S. Case No. 620 of 2019, disclosing offence punishable under Section 395 of the Indian Penal Code.

The petitioner is in custody since 19.11.2019. His prayer for regular bail was earlier rejected by an order of this Court dated 19.03.2021, passed in Cr. Misc. No. 35163 of 2020. The petitioner has renewed his prayer for bail by making this application.

While rejecting the petitioner's prayer for regular bail earlier it was observed that the petitioner shall be at liberty to renew his prayer for bail after six months, if, in the

Patna High Court CR. MISC. No.65627 of 2021(2) dt.01-12-2021 2/2 meanwhile, there was no substantial progress at the trial. Learned counsel appearing on behalf of the petitioner has submitted that except for framing of charge, there has not been any progress at the trial.

Considering the facts and circumstances, particularly, the observation made in the order dated 19.03.2021, passed in Cr. Misc. No. 35163 of 2020, permitting the petitioner to renew his prayer for bail after six months, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Judicial Magistrate 1st Class, Vaishali at Hajipur, in Hajipur Sadar P.S. Case No. 620 of 2019.
