JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2023 At the outset, learned counsel for the petitioners seeks permission to make correction in cause title (address portion of petitioners) of the bail petition, since instead of age of petitioner no. 3 (Amit Kamat) as 45 years, it has been wrongly typed as 23 years.

2. Permission is accorded. It may be done in course of the day.

3. Heard learned counsel for the petitioners and learned Addl. Public Prosecutor.

4. The petitioners apprehend their arrest in a case

Patna High Court CR. MISC. No.56197 of 2023(2) dt.30-08-2023 2/3 registered for the offence under Sections 366(A), 506, 34 of the Indian Penal Code and Section 8, 12 of the POCSO Act.

5. It is alleged that on 17.04.2023 at about 4:00 PM, while daughter of informant went outside to attend call of nature, co-accused Vijay Kamat @ Kallu with the help of petitioners kidnapped her for the purpose of marriage.

6. It is submitted on behalf of petitioners that specific accusation of kidnapping is against co-accused Vijay Kamat @ Kallu. So far as these petitioners are concerned, they have been made accused merely because they happen to be close relative of co-accused Vijay Kamat. Petitioners have got clean antecedent.

7. Learned A.P.P. for the State has opposed the bail petition.

8. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VI cum Special Judge, POCSO, Saharsa in connection with Mahishi P.S. Case No. 108 of 2023, subject to condition as laid down under
