Petitioner seeks regular bail in Chakai P.S. Case No.26 of 2017 registered for the alleged offences under Section 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Amended Excise Act, 2016.
As per the prosecution case, 56 liters of country made liquor was recovered from the pick-up van and the petitioner happens to be the driver of the said vehicle. It is submitted that the petitioner is an innocent person and has committed no offence. Noting incriminating articles have been recovered from his conscious possession.
