The petitioners seek anticipatory bail in a case instituted for the offences under Sections 363 and 366(A) of the Indian Penal Code.
Allegation has been made by the informant that her daughter was taken away on the strength of weapons by the accused persons and she was apprehensive that kidnapping has been done for the purposes of marriage. Patna High Court Cr.Misc. No.30417 of 2018 (2) dt.18-05-2018 been granted anticipatory bail by this Court vide Cr. Misc. No.54325 of 2017.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Rikhlal Yadav, Shanti Devi, Chhatu Yadav and Chandmani Kumari, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bairiya P.S. Case No.44 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that if the petitioners will not co-operate during course of investigation and join for interrogation the police will be at liberty to file an application for cancellation of bail.
