2. The petitioner has preferred this application for grant of regular bail in connection with Chakmehashi P.S. Case No. 72 of 2024 dated 26.05.2024 registered for the offences punishable u/ss 341, 323, 447, 302, 504 read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused persons along with one unknown person are alleged to have brutally assaulted the informant's brother and his niece with lathi and danda as a result of which the informant's brother got badly injured and in course of treatment at D.M.C.H., Darbhanga, he died.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.55119 of 2025(2) dt.10-11-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the incident took place in night but no source of light has been stated in the fardbeyan to identify the person who assaulted the informant's brother. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The other co-accused person has already been granted bail by this court vide order dated 14.05.2025 passed in Cr. Misc. No. 27443/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 18.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Chakmehashi P.S. Case No. 72 of 2024 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of
