The petitioner seeks regular bail in connection with Tariyani P.S. Case No. 28 of 2017, registered under Sections 30(1) and 33 of Bihar Prohibition of Excise Act, 2016. The allegation leveled against the petitioner is with regard to the police receiving secret information regarding illicit liquor being stored at the place of occurrence. Accordingly, the police is said to have carried out a raid at the place of occurrence and one litre of country made liquor was recovered from there. However, the petitioner managed to escape from the place of occurrence but his daughter was apprehended.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.26718 of 2017 (2) dt.13-06-2017 2/2 daughter of the petitioner has already been granted bail. It is further submitted that the petitioner is in custody since 15.04.2017.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 28 of 2017.
