JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with G. B. Nagar P.S. Case No. 312 of 2021 registered for offence punishable under sections 302, 120(B), 34 of the Indian Penal Code and section 27 of the Arms Act.

The informant is the father of deceased Dheeraj Yadav @ Santu Yadav. As per allegation, co-accused Ajay Mahto along with 3-4 unknown persons came to the mobile and gas refilling shop of the deceased. They made allegation against him that he made viral a video, in which co-accused Sunil Prasad Gupta was seen with musical artists working in musical group of Ajay Mahto. The learned counsel for the petitioner has submitted that the allegation against the petitioner is general and omnibus and

Patna High Court CR. MISC. No.57777 of 2022(3) dt.13-03-2023 2/2 co-accused Ajay Mahto has been granted regular bail by a coordinate Bench of this Court, vide Cr. Misc. No. 18745 of 2022 and other coaccused persons on similar footing have been anticipatory bail by a coordinate Bench of this Court in Cr. Misc. Nos. 18721 and 18828 of 2022. The case of the petitioner is on betting footing than co-accused Ajay Mahto.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with G.B. Nagar P.S. Case No. 312 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
