The petitioners seek bail in a case registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioners are in custody since 10.08.2021 and chargesheet has been submitted. Petitioners are persons with clean antecedent. Learned counsel for the petitioners submits that the informant alleges that on the orders of Sinku Yadav, the accused Pinku and Shishupal fired on the father of the informant, who died at the spot and the occurrence was witnessed by the

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. As far as allegation of firing is concerned, the same is against Pinku and Shishupal on the orders of Sinku Yadav. It is further submitted that petitioners are not alleged to be the assailants. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody since 10.08.2021, chargesheet has been submitted in the case, the petitioners are persons with clean antecedent and petitioners are not the assailants, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Belhar P.S. Case No. 214 of 2021.
