JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2018 The petitioner is apprehending his arrest in connection with Biraul P.S. Case No. 86 of 2017, registered for offences punishable under Sections 448, 341, 323, 354, 315, 504 and 34 of the Indian Penal Code.

Allegation against the petitioner and others is that they entered inside the house of the petitioner and assaulted the informant and co-accused of this case disrobed her and it is alleged that this petitioner assaulted the informant causing miscarriage of three months pregnancy.

It has been submitted on behalf of the petitioner that out and false and fabricated allegation has been levelled against the petitioner and there is no injury report available on record to substantiate the allegation and allegation of disrobing the informant is against co - accused of this case.

Patna High Court Cr.Misc. No.36423 of 2018 (3) dt.11-07-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail rather the petitioner should surrender before the court below and pray for regular bail and if any such application is filed, the court below after verifying the above submissions of learned counsel for the petitioner shall pass an appropriate order.
