JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 This application, for grant of anticipatory bail, arises out of Kothi P.S. Case No. 19 of 2019, disclosing offences under Sections 414/34 of the Indian Penal Code. Prosecution case is that some accused persons arrested in Kothi P.S. Case No. 18/2019 disclosed that some stolen motorcycles are kept in the house of the petitioner, on which, the police raided the house of the petitioner, from where, two splendor motorcycles and two luna motorcycles were recovered.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and petitioner has show the papers with respect to two motorcycles and so far other two motorcycles are concerned, the same has been kept by his enemy to implicate

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner, however, the petitioner, if so desire, may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
