JUSTICE ARUN KUMAR ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Masaurhi P.S. Case No.74 of 2017 registered under Section 30 (A) of Bihar Prohibition and Excise Act, 2016 and Section 290 of the Indian Penal Code.

Allegation in brief is that 40 bottles of Royal Stage each containing 750 ml, which cumulatively comes to 30 litres. It is alleged that the recovery is made from the rented house of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the said wine was recovered from the passage leading to the rented out of the petitioner and other renters and this petitioner has got no criminal antecedent and has been in custody

Patna High Court Cr.Misc. No.23883 of 2017 (2) dt.14-06-2017 2/2 in this case since 12.3.2017 and charge sheet too has been submitted in this case.

Having considered the said facts and circumstances, the petitioner, namely, Sonu Goswami is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ranjay Kumar, J.M.-1st Class, Masaurhi, District- Patna in connection with Masaurhi P.S.
