The petitioner seeks bail in anticipation of his arrest in connection with Paharpur P.S. Case No. 12 of 2018 dated 10.01.2018 instituted for the offences under Sections 147, 341, 323, 324, 307, 427, 379 and 504 of the Indian Penal Code.
The petitioner is alleged to have given a farsa blow on the head of the informant leading to injuries. One Vijay Ojha is also said to have assaulted the informant.
Learned counsel for the petitioner has submitted that the implication of the petitioner in this case is because of old land dispute and that there is a counter version of the occurrence vide Paharpur P.S.
Patna High Court Cr.Misc. No.31223 of 2018(3) dt.28-06-2018 2/2 Case No. 11 of 2018 dated 10.01.2018 which too has been instituted for the offences under Section 307 and other Sections of the IPC. The injuries suffered by the informant is simple in nature (refer to Annexure-4). The petitioner does not have any criminal antecedent.
For the aforestated facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S. Case No. 12 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
