1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109(1), 352 and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that similarly situated seven co-accused had moved this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 52825 of 2025 (Laxmikant Rai & Ors. Vs. The State of Bihar) and the same was allowed by an order dated 12.08.2025 passed by a learned Coordinate Bench. It is next submitted that the case of the petitioner herein is similar to the case of Laxmikant Rai &
Patna High Court CR. MISC. No.54371 of 2025(2) dt.21-08-2025 2/2 Ors., as there is not specific allegation of assault against the petitioner also.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the order dated 12.08.2025 passed in Criminal Miscellaneous No. 52825 of 2025, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Manigachhi P.S. Case No. 55 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.
6. Accordingly, the instant anticipatory bail application is allowed.
