JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being lady is languishing in jail custody since 13.12.2015 and the victim has only stated in her statement recorded under section 164 of the Cr.P.C that she had gone to temple along with the petitioner but, even then, the learned Additional Sessions Judge 2nd, Saharsa has rejected the prayer for bail of the petitioner without applying his judicial mind. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Nauhatta P.S.case No. 250 of 2015.
