Heard learned counsel for the petitioners as well as the learned APP for the State.
The petitioners apprehend their arrest in connection
Patna High Court CR. MISC. No.65133 of 2021(2) dt.21-07-2022 2/3 with Majhauliya P.S. Case No. 361 of 2021, registered for the offences punishable under Sections 447, 341, 323, 324, 325, 307, 354, 504/34 of the Indian Penal Code.
As per allegation, there was some land dispute between the prosecution side and the defense side. The seven accused persons named in the FIR started abusing the informant and on protest they assaulted the members of prosecution side. Learned counsel for the petitioners has submitted that there is case and counter case. Both the parties have injured. There is admittedly land dispute between the parties. He has also submitted that all the injuries sustained by the injured persons are simple in nature except one injury on the person of Chandra Kishore Ram which was found grievous but it was not specifically attributed against any of the petitioners rather it is general and omnibus in nature.
Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 361 of
Patna High Court CR. MISC. No.65133 of 2021(2) dt.21-07-2022 3/3 2021, subject to the conditions as laid down under Section 438
(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
