Petitioner apprehends arrest in Mahua PS Case No. 273 of 2017, registered under Sections 302/34 of the IPC. The allegation in brief is that due to land dispute after midnight the accused persons turned up and killed his father by shooting at him and when the informant reached here he found the petitioner standing there with pistol in his hand.

Submission is that other c-accused persons have been admitted to anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 11578 of 2017 and the case of petitioner stands on similar footing.

Whereas learned Counsel for the State submits that only the petitioner was found armed with pistol and the informant's father was shot in his head causing his death, case of the petitioner stands on different footing to the other co-accused granted anticipatory bail. Having considered the said facts and circumstances, the prayer for anticipatory bail of the petitioner is rejected. The petitioner is directed to surrender in the court below and seek regular bail which shall be considered on its own merit without being prejudiced by the present order. Snkumar/- (Arun Kumar, J) U T
