The petitioner is accused in connection with Jogbani P.S. Case No. 26 of 2015, registered under Sections 341, 323, 326 and 307/34 of the Indian Penal Code.
The accusation is that Seema Devi was threshing Masoor grain in that course Sanjeet Sharma, son of the informant made protest then he was abused and also assaulted by a piece of the wooden log at his head by the petitioner, when Amit Sharma and Shiv Kumar Sharma rushed to rescue him then they were also assaulted by Lalu Das (Petitioner) causing injury to the Shiv Kumar Sharma.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.9223 of 2016 (2) dt.01-04-2016 2/2 petitioner submits that, in fact, in the said occurrence petitioner and other members were also sustained injuries, moreover, the injury received by Sanjeet Sharma and Amit Sharma caused by hard and blunt substance. Regarding the said occurrence on the basis of the written report of co-accused Sima Devi Jogbani P.S. Case No. 27 of 2015, under Section 147, 148, 323, 325, 379, 354, 504 was instituted against the informant and others. The petitioner having no criminal antecedent is in custody since 02.01.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Araria in connection with Jogbani P.S. Case No. 26 of 2015. (Rajendra Kumar Mishra, J.) manish/- U T
