The petitioners, being the mother-in-law and brother-in-law of the victim are apprehending arrest in a case registered for the offences punishable under Section 306 of the Indian Penal Code.

The prosecution case got initiated on the basis of written report dated 23.02.2018 submitted by Subodh Kumar to the Station House Officer, Punpun Police Station, to the effect that on 22.02.2018, at 8.30 P.M., the informant received information that his elder brother Pramod Kumar has committed suicide by hanging himself. Patna High Court Cr.Misc. No.30713 of 2018(2) dt.18-05-2018 2/3 found that his brother has committed suicide by hanging himself by putting a towel around his neck and hanging himself. The brother of the informant was residing separately in a rented house of one Pyare Singh at Pakri since the last two and half years. The wife of the victim was not residing with him. It is submitted by learned counsel for the petitioners that the victim committed suicide due to physical and mental torture of his wife. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent. Moreover, co-accused have been granted anticipatory bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.26697 of 2018.

It is submitted by learned APP for the State that the petitioners are named in the FIR.

Considering the fact that co-accused have been granted anticipatory bail and the victim committed suicide due to repeated torture by wife, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Masaurhi at Patna in
