Petitioners are in judicial custody since 12.01.2016 in connection with Sikty P.S. Case No. 41/15 for offences alleged under Sections 147, 148, 323, 341, 447, 307 and 504 of the Indian penal Code.
The prosecution case, as lodged by the informant, is that on 14.05.2015 at 7.00 P.M. Sudhanshu Kumar Jha, Ranvir Kumar Jha, Binodanand Jha, Sri Kumar Jha, Vivek Kumar Jha, Pipin Jha entered into the house, started abusing and threatened to kill and assaulted Mamata Devi by butt of the pistol on the head resulting in injury. On hulla accused persons put Bhaisur Gopal Jha, husband Subodh Jha and Dewar Anil Jha on the ground and
Patna High Court Cr.Misc. No.9387 of 2016 (2) dt.29-02-2016 started pressing their neck. On hulla Pradeep Kumar Jha, Dilip Jha, Jagarnath Singh, Deepak Kumar Singh brought the informant to Sikty Hospital.
It has been submitted by the learned counsel for the petitioners that there is counter version against the informant's side bearing Sikti P.S. Case No. 40/15 by the petitioners' side in which both sides received injuries. He further submits that one of the co-accused, namely, Vinodanand Jha has been granted the privilege of bail by the Sessions Judge, Araria. It has also been submitted that petitioners have no criminal history, as is evident from paragraph 3 of this petition.
Be that as it may, let petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate No.III, Araria in connection with Sikty P.S. Case No. 41/15.
